Section 401 Water Quality Certification review is required for any federal permit or license that may result in a discharge to waters of the U.S. to ensure that proposed project activities will not violate the state’s water quality standards or designated uses. States are authorized to issue certification under Section 401 of the federal Clean Water Act and the majority of certification requests are for dredge and fill operations regulated by the U.S. Army Corps of Engineers. The WVDEP will provide an overview of the Section 401 Water Quality Certification program and guide you through the individual certification process as well as the expedited review process for activities covered by Nationwide Permits or Regional General Permits.
